The four elements are: (1) the initiation of a criminal proceeding by the defendant against the plaintiff; (2) the termination of the criminal proceeding in favor of the plaintiff; (3) malice on the part of the defendant; and (4) a lack of probable cause for the criminal proceedings. If the plaintiff can prove all four elements of malicious prosecution, then they may be awarded damages by a court, including compensatory damages and punitive damages. There are two types of malicious prosecution claims in Oklahoma: malicious prosecution of a criminal action and malicious prosecution of a civil action.
