The New Jersey Order for Interim Payment in Death Penalty Cases, 2017 (the “Order”) is a legal document issued by the Supreme Court of New Jersey. The Order outlines the procedures that must be followed for the payment of attorney fees and expenses in death penalty cases in the State of New Jersey. The Order applies to all death penalty cases that are pending or have been decided in the Supreme Court of New Jersey. The Order provides for three types of payments, all of which must be approved by the Supreme Court: 1. Interim payments: These are payments made to an attorney before the completion of a death penalty case. The payment amount must be approved by the court and is based on the amount of work performed and the fees requested by the attorney. 2. Final payments: These are payments made to an attorney after the completion of a death penalty case. These payments are based on the amount of work performed and the fees requested by the attorney, as well as any costs or expenses incurred by the attorney in the course of the case. 3. Reimbursement payments: These are payments made to an attorney to reimburse them for expenses that were incurred in the course of a death penalty case. These payments must be approved by the court. The Order also outlines the procedures for filing a motion for payment, as well as the criteria the court will consider when determining the amount and timing of payments.
