A Missouri Waiver of Interested Party (MIP) is a document used to release a potential beneficiary of an estate from any right to receive any part of the estate. It can be used to release an individual from any claims against the estate, such as inheritance, debts, or other obligations. There are two types of Missouri Waiver of Interested Party: a Waiver of Inheritance and a Waiver of Intestate Share. The Waiver of Inheritance allows a potential beneficiary to waive any right to receive an inheritance from an estate or trust. The Waiver of Intestate Share releases a potential beneficiary from any right to receive a share of the estate under the laws of intestacy. Both types of MIP must be executed before the death of the person establishing the estate or trust. Additionally, both require that the person waiving their rights be at least 18 years of age and of sound mind. The Waiver of Intestate Share also requires that the person have received notice of their potential interest in the estate prior to waiving their rights.
