Michigan Complaint, Nonpayment of Rent, Landlord-Tenant is a legal action that a landlord can take against a tenant who has not paid rent. A Michigan Complaint is a document that a landlord files with the court to initiate the eviction process. The Complaint will state the amount of rent due and will request the judge to order the tenant to pay the rent or move out. There are two types of Michigan Complaint, Nonpayment of Rent, Landlord-Tenant: 1) Summary Process Complaint: This is the most common type of Michigan Complaint and is used when a tenant has not paid rent. The landlord must serve the tenant with the Complaint and the tenant has seven days to file a written response. If the tenant does not respond, the landlord can request a hearing in front of a judge. At the hearing, the judge will decide if the tenant must pay the rent or move out. 2) Termination of Tenancy Complaint: This type of Michigan Complaint is usually used when the tenant has broken a lease agreement or violated other terms of the rental agreement. The landlord must serve the tenant with the Complaint and the tenant has 14 days to file a written response. If the tenant does not respond, the landlord can request a hearing in front of a judge. At the hearing, the judge will decide if the tenant must move out or be allowed to stay in the rental unit.
