A Louisiana Notice of Claim Against Second Injury Fund is a legal document that is used by an injured worker to claim benefits from the Louisiana Second Injury Fund. This fund was established in order to provide compensation for an employee who has been injured on the job and experienced a greater degree of disability due to a pre-existing physical condition. The Notice of Claim must be filed with the Second Injury Fund Board within one year of the date of injury or the date of the last payment of compensation. The Notice of Claim must include the claimant’s name, address, and telephone number; a brief statement of the claim, including the date of injury, nature of the injury, and benefits claimed; and a copy of all documents related to the claim, including medical reports, medical bills, and other evidence. There are two types of Louisiana Notice of Claim Against Second Injury Fund: the Notice of Claim for Compensation and the Notice of Claim for Medical Care. The Notice of Claim for Compensation is used when the claimant is claiming benefits from the Second Injury Fund, while the Notice of Claim for Medical Care is used when the claimant is seeking medical care or treatment related to the injury.
