An Illinois Small Estate Affidavit is a legal document that can be used by an heir or personal representative of an estate to collect property from a deceased person's estate. This document helps to speed up the process of collecting the estate's assets by allowing the heir or personal representative to collect assets without having to go through the probate process. There are two types of Illinois Small Estate Affidavits: the Small Estate Affidavit for Collection of Personal Property and the Small Estate Affidavit for Collection of Real Property. Both of these affidavits are used to transfer property from the deceased person’s estate to the heir or personal representative of the estate. The Small Estate Affidavit for Collection of Personal Property must be signed by the heir or personal representative, must include a description of the deceased person’s assets and liabilities, and must include a list of all beneficiaries of the estate. The Small Estate Affidavit for Collection of Real Property must be signed by the heir or personal representative, must include a description of the deceased person’s real estate, and must include a list of all beneficiaries of the estate. In order to use either of these affidavits, the total value of the estate must be less than $100,000.
