An Illinois Small Claims Complaint is a legal document used to initiate a civil action in the state of Illinois. It is a simplified form of civil litigation used by individuals or small businesses to resolve disputes of up to $10,000. The two types of Illinois Small Claims Complaints are: Complaint (Form SC-1) and Counterclaim (Form SC-2). The Complaint is used to initiate a claim by the plaintiff and the Counterclaim is used to respond to the Complaint by the defendant. The Complaint must include the names and addresses of the parties, a brief statement of the facts, and the relief sought. The Counterclaim must include the same information as the Complaint, as well as any additional facts and the relief requested. Once the Complaint and Counterclaim are filed, the court will set a hearing date and notify both parties. At the hearing, the parties will present their case to the court, and a decision will be rendered.
