2023 California Rules of Court. In an appeal in which any party is both an appellant and a respondent: (1) The parties must jointly-or separately if unable to agree-submit a proposed briefing sequence to the reviewing court within 20 days after the second notice of appeal is filed.

What Is a Motion for Extension of Time to File Responsive Pleading? The court is authorized to extend the deadline for ?an act to be done.? Code of Civ. Proc., § 1054. The court may only extend the deadline by 30 days unless the other party consents to a longer period.

The parties may stipulate without leave of court to one 15-day extension beyond the 30-day time period prescribed for the response after service of the initial complaint. The court, on its own motion or on the application of a party, may extend or otherwise modify the times provided in (b)-(d).

Rule 8.63 of the California Rules of Court directs that the court ?must consider? ?illness of counsel? or ?a personal emergency,? among many other factors, in determining good cause for a requested extension of time. (Cal. Rules of Court, rule 8.63(b) (10).)
