If this agreement is entered into at the time the employee is employed, the promise of the employer to employ and pay compensation is consideration for this agreement. If the employee's promise is made after the original hiring date, and the employee does not have a contract of definite duration in time (i.e., is an employment at will), then the agreement would be binding on the employee in many states because the employer would be able to fire the employee if the employee did not enter into the contract.
