In Virginia, landlords can evict tenants for a lease violation. The landlord must give tenants a 30-Day Notice to Comply, which provides them with 21 days to fix the issue.

In Virginia, the tenant eviction process normally takes anywhere between 2 to 4 months to complete. The exact period of notice period depends on a myriad of factors. This includes the reason for the eviction, whether the tenant contests it, and whether the tenant appeals the court's decision.

If the landlord wants to terminate a month-to-month lease for a reason other than non-payment of rent, the landlord must give you a written notice to move out in 30 days if the rent is paid each month. If it's paid by the week, then only a 7-day written notice is required.

The notice can say that if you don't correct it within 21 days, then the lease will terminate in 30 days after the date of the written notice. This process is called a “21/30 notice.” If it's a problem that can't be fixed, then the landlord can give you a written notice that the lease will terminate in 30 days.

If a tenant receives a 30-day notice, it is NOT AN EVICTION. It means that the landlord no longer wishes to continue the tenancy, but it does not mean that the tenant has violated the lease and it will not come up as an eviction on the tenant's rental history.

The Virginia Notice to Vacate does not evict the tenant or terminate the Virginia Lease Agreement.
