Minnesota has no cure notice requirement and no statute (like the one in Wisconsin) has altered the common law definition of “default.” As a result, if Wisconsin law governs the definition of “default,” Credit Acceptance prematurely sent the cure notice.

Buyer's liability. The buyer may be liable in damages to the seller or lender if the buyer has wrongfully damaged the collateral or wrongfully failed to make the collateral available to the seller or lender.

Minnesota doesn't require prior notice, except when a Cobb notice or letter is mandated. Lenders are required to provide a repossession notice to the borrower if that lender has accepted a borrower's late payment more than once during their loan term without repossessing the vehicle.

Fill the Minnesota certificate of title – including: Full legal name and address of buyer and current owner. Date of sale (month, day, and year) Vehicle price the buyer paid. An odometer recording (unless: 10 years and older and weighing over 16,000lbs) A damage disclosure if the vehicle is less than 6 years old.

Statute of limitations. In most Minnesota debt collection cases, such as credit cards, the statute of limitations is six years. However, the statute of limitations for a repossession deficiency claim is likely four years.

You can get the property back by paying off the loan and repossession costs. You may also be able to work out a payment plan or find another buyer who would pay a good price. The second letter comes after the sale. It must tell you how much the car sold for and say if you still owe any money to the creditor.

In Minnesota, repo companies must allow you to retrieve any personal property left behind in a repossessed car. However, they can charge you for storing your personal property until you pick it up. You aren't entitled to retrieve anything that's attached to the vehicle once it's repossessed.

Transfer Title by Court Order If the transfer of title cannot be completed using the Certificate of Title document, the buyer or the seller may ask for a court order to transfer the title. This takes time and effort and costs money.
