To start your home care business, you will need to apply for your home care license in Kentucky. A home care license application with home care policies and procedures will need to be compiled and sent to the State of Kentucky with a fee of $500. Initial Licensure can take up to 6 months.

The Kentucky Certificate of Need process prevents the proliferation of health care facilities, health services and major medical equipment that increases the cost of quality health care in the Commonwealth.

The Office of Inspector General is Kentucky's regulatory agency for licensing all long-term care facilities in the commonwealth.

Kentucky enacted its first CON program in 1972, two years before the passage of the National Health Planning and Resources Development Act of 1974, which made certain federal funds contingent on the enactment of CON programs, and provided a strong incentive for the remaining states to implement CON programs.

Since 1975, Ohio has restricted the supply of health care with certificate-of-need (CON) programs. These programs prohibit health care providers from entering new markets or making changes to their existing capacity without first gaining the approval of state regulators.

The Tennessee Health Services and Development Agency is responsible for regulating the health care industry in Tennessee through the Certificate of Need Program. A Certificate of Need ("CON") is a permit for the establishment or modification of a health care institution, facility or service at a designated location.

The state of Kentucky doesn't require residents to have health insurance coverage, but the Affordable Care Act does mandate health insurance coverage on the federal level. While you won't suffer any tax penalties for not having coverage, not being insured will disqualify you for the Advanced Premium Tax Credit.

Minnesota has ambulance CON requirements and caps on services and facilities. Eleven states have no CON laws or caps: California, Colorado, Idaho, Kansas, New Hampshire, North Dakota, Pennsylvania, South Dakota, Texas, Utah, and Wyoming (see the accompanying chart).
