Your child may be eligible for accommodations under a 504 Plan if he or she has a physical or mental health disability that limits one or more major life functions. A 504 Plan is supported by the federal civil rights law, Section 504 of the Rehabilitation Act of 1973 (see page 72).

You can set up a 504 Plan in Florida if your child has an impairment that impacts one of the following major life activities: Caring for his or herself. Performing manual tasks. Learning or working.

All Washington state public schools must comply with this federal law. Section 504 requires public schools to provide a "free appropriate public education" (FAPE) to every student with a disability—regardless of the nature or severity of the disability.

Section 504 of the Rehabilitation Act prohibits discrimination based on a disability in programs or activities receiving federal financial assistance including public preschool, elementary, secondary and postsecondary schools. Under Section 504, students with disabilities have rights to reasonable accommodations.

Under Section 504, a person may be considered disabled if the individual: has a mental or physical impairment, which substantially limits one or more major life activities. Persons protected from discrimination include those who have: a record of such impairment; or is regarded as having such impairment.

The basic difference between an IEP and a 504 plan can be summed up in one sentence: both plans provide for accommodations, but only an IEP provides for specialized instruction for students in grades K–12, while a 504 plan can serve students at both the K–12 and college levels.

In Florida special education is called Exceptional Student Education or ESE. Every child with a disability who is eligible under IDEA and ESE has an Individual Education Plan or IEP. The IEP is an individualized written plan that supports the need for specialized supports and services.

Data used for the evaluation and determination of a disability and required accommodations can be broad and may include, but is not limited to, medical records, school records, standardized test results, classroom observations, and anecdotal records.
