How long does a caveat last in Victoria? A caveat will remain on the title until it is withdrawn by the caveator or forcibly removed by the property owner.

Removing a Caveat The response to a Warning is called an Appearance – it sets out the reasons why the Caveat should remain in force and results in the Caveat remaining on the Register until it is removed following the decision of a District Judge (or a Registrar if the parties later agree the removal of the Caveat).

A caveat is a warning (in land law) that someone is claiming an interest on a parcel of land. If you believe you are entitled to an interest in land, you may file your claim through a caveat. A caveat is only a notice of a claim of interest on land. The validity of the claim is disputed in court.

Property owners gain longer term protection. Unlike priority notices, a caveat remains on title until it lapses, is removed by court order, is formally withdrawn, or when the interest in the caveat is satisfied by the registration of a subsequent dealing or plan.

A caveat can be withdrawn at any time before entering an appearance by the caveator writing to the district probate registry at which the caveat was entered. The caveator must give notice of the withdrawal to anyone who has warned the caveat.

If the Registrar agrees with your reasons for entering an appearance, they'll make the caveat permanent. Then it can only be removed by order of a District Probate Registrar, High Court Judge or District Judge.

The application must be made on a Caveat – 21-day notice application (s138B) e-Form (or paper Form AW) describing the land affected, the number of the caveat required to be removed and requesting that 21 days' notice be sent to the caveator under s. 138B of the TLA.
