Schools and 501(c)3 Status But because the Internal Revenue Service (IRS) generally treats public schools as government entities, they are automatically exempt from federal income tax, meaning they are tax exempt. Schools are not automatically considered to be 501(c)3 organizations.

Some common examples of organizations that may qualify for tax-exempt status include child care, churches and religious, and social welfare organizations.

Along with federal tax exemptions, 501c3 nonprofits usually receive exemptions from state and local sales and property taxes as well. Other areas that they often receive discounts include postage and advertising. They're also exempt from lawsuits.

When you file exempt with your employer, however, this means that you will not make any tax payments whatsoever throughout the tax year. Therefore, you will not qualify for a tax refund unless you are issued a refundable tax credit.

To apply for tax-exempt status, you must complete IRS Form 1023, Application for Recognition of Exemption Under Section 501(c)(3) of the Internal Revenue Code. Completing this form can be a daunting task because of the legal and tax technicalities you'll need to understand.
