Designed to protect dependent and elderly residents of California, the Elder Abuse and Dependent Adult Civil Protection Act (EADACPA) was created by the state legislature in 1982. Why? Because this especially vulnerable age group is more prone to neglect, abandonment, and abuse.

Historically in California, “elder abuse” has been defined as age 65 and above for purposes of prosecution and pursuit of civil remedies.

Message to Participants: Neither can mandated reporters hand this responsibility over to another staff member. Mandated reporters must report the incident themselves, they must follow through and no one can alter this legal responsibility.

State law requires that mandated reporters immediately report cases of suspected abuse or neglect of an elder or dependent adult to Adult Protective Services (APS). Emergencies: Call 911 if an elder or dependent adult is in immediate physical danger. Non-urgent, online reports: Submit a referral on reporttoaps.org.

Under CA law patients do not retain the right to refuse reporting. A mandated reporter is required to call the Police Department in the city where the incident occurred immediately or as soon as is practicable. Turn in a written report within 48 hours to the Police Department in the city where the incident occurred.

Mandated reporters in California must file an initial report within 36 hours of awareness of any suspected abuse or neglect. Finally, California stipulates provisions for follow-up reports and collaboration between mandated reports and investigating agencies.
