In order to gain custody of a child, a parent must make a request with the court, called a petition for child custody. This request must be filed with the Family Law Court of the Superior Court of California in San Diego.

At the conclusion of your FCS session, the Family Court Services Counselor will identify in writing those issues on which you reached an agreement as well as those issues on which you were unable to reach agreement. This is known as the FCS Report.

The Family Court is a special Court established under the Judicature (Family Court) Act. It is responsible for all legal proceedings relating to family life, except for divorce. It differs from other Courts in that its structure includes social services.

To reduce acrimony that may exist between the parties; To develop an agreement ensuring that the child has close and continuing contact with both parents, in the best interest of the child; To settle the visitation rights of all parties in a way that is in the best interest of the child.
