However, O.C.G.A. §16-3-1 states that the minimum age for criminal prosecution is 13 years old because a child under the age of 13 cannot form the requisite criminal intent to commit a delinquent act.

Any child age 17 and over is considered an adult under Georgia law. However, if the juvenile commits the crime on the last day of his/her 16th year, he/she may be treated as an adult, no matter how minor the offense.

The Intake process begins when a citizen makes a complaint to the Juvenile Court involving an alleged delinquent or unruly act by a juvenile. The juvenile is either released to their parents or placed in the detention center pending a hearing.

Police can question a child without a parent present and are not required to obtain permission from a parent before questioning the child. ... Children themselves can refuse to be questioned and can also request that a lawyer or a parent be present during any questioning.

The Georgia Department of Juvenile Justice is a multi-faceted agency that serves the state's youthful offenders up to the age of 21.

As of January 22 of this year, there are 827 youths housed in secure detention centers across the state.

Juveniles constitute 1,200 of the 1.5 million people housed in federal and state prisons in this country, and nearly 200,000 youth enter the adult criminal-justice system each year, most for non-violent crimes. On any given day, 10,000 juveniles are housed in adult prisons and jails.

But how many of the 18,000 children and adolescents in juvenile detention centers should really be there? According to government guidance, the purpose of juvenile detention is to confine only those youth who are serious, violent, or chronic offenders pending legal action.
