Oregon law allows a parent or legal guardian of a minor child to temporarily give another person the authority to care for the child and make decisions with regard to the child for a limited period of time.

There are three kinds of guardianships. In an emergency, one can seek what is called a “Temporary Guardianship.” These temporary guardianships can sometimes be obtained on an expedited basis.

The simple solution is to get written permission from one of the parents. It can be handwritten and include only the date, the name and birth date of the child, the name of the person authorized to get care for the child, and a statement that the parent permits the person to authorize necessary medical and dental care.

You will need a lawyer to ask a judge to appoint a guardian. Parents and the people taking care of the child must be told when someone is trying to get a guardian appointed. A judge will order a guardianship without the parents' consent only in limited circumstances.

Under Oregon law, a delegation of parental/guardian rights is effective for a maximum of six months. You can limit this time period to as little as you want, but you cannot extend it beyond six months. If you need another power of attorney after six months, a new power of attorney may be signed.

In an emergency, a judge can appoint a temporary guardian, a temporary conservator or both. A judge may order action be taken on behalf of an adult without appointment of a guardian or conservator. This is called a protective order. Any adult can file a petition in court to have a guardian appointed for another person.
