Community control in Florida is a non-incarceration option given solely to convicts. Community Control allows an offender to live at home while traveling to a pre-determined list of destinations, which typically includes work, school, treatment, and community service.

1. Petition the Court: You or your attorney must file a motion for early termination with the court that sentenced you to probation. 2. Notice to the Prosecutor: The State Attorney's Office must be notified of your motion and given an opportunity to respond.

It also includes offenders placed on court ordered supervision including regular probation, administrative probation, drug offender probation, sex offender probation, and community control. Correctional Probation Officers also supervise offenders placed on pre-trial intervention.

Community Control is sometimes available to a Defendant who is not considered a good risk for probation. The Defendant is placed with the Florida Department of Corrections and this form of supervision is stricter and much more closely supervised than ordinary probation.

A community control sentence in Florida is limited to a maximum of two years. Meaning, an offender may be placed on community control for up to two years, but probation – the length of which varies depending on the sort of offense – may be imposed after that.

If an offender on community control is subsequently placed on probation, he or she must complete half of the probationary term to which he or she was sentenced, without receiving credit for time served on community control, before being eligible for mandatory early termination or conversion to administrative probation ...

A Motion to Dismiss VOP is a legal document filed by your defense attorney challenging the court's jurisdiction over your case. This challenge is often based on the specifics of the Mobley Motion to Dismiss and whether appropriate actions were taken before your probation term's natural expiration.
