The Form 13 can be used to amend a Lease, Easement, Mortg...

If you're buying or selling property with tenants in Queensland, you are probably wondering what happens to the lease once the property is sold. The short answer is that the lease will continue after the sale, with the new owner taking over the rights and responsibilities of the previous owner.

Will the new owner honour your lease or will you have to move out? Under current Queensland laws, if a house changes ownership, and renters have a fixed-term agreement, such as a six month or 12 month lease, the new owner still has to honour the lease period.

Sale of the property Where the tenant has signed a tenancy agreement for a fixed term, the landlord cannot evict the tenant prior to the end date noted in the agreement. However, if the tenant is on a periodic tenancy (such as month to month) they can be asked to vacate the property with four weeks notice.

In residential tenancies, you must be given at least two months notice. In rooming accommodation, you must be given at least 30 days notice. You can be given this notice whether you have a periodic agreement or a fixed term agreement.

The Notice of intention to leave (Form 13) is used when the tenant/s are giving notice to the lessor/agent that they wish to vacate the premises by a certain date.

Notice of intention to leave form (Form R13) is given to the agent or manager/provider when the resident/s want to end the accommodation agreement and leave by a certain date. The resident can use this form: to end a periodic agreement. at the end of a fixed term agreement.

For the reasons listed below, you must first issue the tenant with a Form 12: Notice of Leave. If the tenant does not comply with the notice by not leaving on the desired date, the landlord can apply to the court for an order that requires the tenant to leave.
