From the moment you file the I-360 form, it may take between 16 to 21 months for your VAWA self-petition to be processed. The U.S. Citizenship and Immigration Services will then issue a Prima Facie Determination Notice to VAWA petitioners who qualify and fulfill all requirements.

After you get the approval case status notice, you will receive a welcome notice from USCIS via mail within 30 days. Then, within 30 days of getting the welcome notice, the green card should arrive in the mail. USCIS sends both items using the address it has on file.

If the VAWA application is granted, the applicant receives deferred action and can apply for work authorization while they wait to file the Form I-485, which is the Green Card application.

Now that USCIS has approved your VAWA green card, you should wait to receive your official notice of approval or welcome by mail. After that, you will receive your actual green card by mail. The processing time can be 30–60 days after seeing “Case Approved.”

The documents which need to be submitted are: Copy of the birth certificate or other documents proving his age. The court issued documents which establish the eligibility for the classification. Consent copies from the US Department of Health and Human Services or HHS if the juvenile is in their custody.

Before filling out the I-360 petition, you must already have received approval from the Chief of Mission (also called COM). There is no filing fee for submitting the I-360. The form may be submitted via email or mail. You can find the Form I-360 form on USCIS' website.

Once the visa program is open, you will be able to apply for your green card on your own. Nevertheless, with an approved I-360, you can remain lawfully in the United States. Moreover, within this period, you can apply for work authorization. You may also apply for employment authorization while you wait for your visa.

After Your I-360 Receives USCIS Approval The main form for this is USCIS Form I-485, and more detailed instructions are found in How to File for Adjustment of Status (a Green Card) Based on VAWA. If the abuser is a U.S. citizen, you are eligible to apply to adjust status as soon as your I-360 has been approved.
