If you want to change a parent who was listed on the child's original birth certificate, that must be done through the court system. This is referred to as an “adjudication” – the court will decide (adjudicate) the existence or nonexistence of the parent and child relationship.

This is o_cially called a “rescission” and CANCELS the legal parent/child relationship created by the VDOP. Only one parent's signature is required to rescind a VDOP. • If either parent was under 18 when they signed the VDOP, different rules apply.

To ask a judge to cancel (set aside) a Voluntary Declaration of Parentage or Paternity (VDOP), you fill out and file a court form. When you file the form, the clerk will give you a court date (a hearing date). At the hearing, you and the child's other parent will both get the chance to speak to the judge.

Copies of this form are maintained in confidential files of the Department of Child Support Services. Declarants have the right of access to their filed form(s) upon request by calling (866)-249-0773.

A Voluntary Declaration of Parentage (or paternity) (a VDOP) is a government form two parents can sign to create a legal parent-child relationship between a child and parent. It's often signed at the hospital when a child is born, but it can be signed later.

Therefore, a birth certificate DOES NOT establish legal parentage when parents are unmarried. Only signing a Voluntary Declaration of Parentage or obtaining a judgment in court legally establishes parentage for the children of unmarried parents.

To cancel it, within 60 days of signing: Fill out a California Voluntary Declaration of Parentage (VDOP) Rescission (form DCSS 0915) Sign the form in front of a Notary. Make 2 copies of the form. Send a copy of the signed form by certified mail to the other parent (keep the other copy for your records)

Either parent who signed the VDOP can cancel or rescind it within 60 days of the date the last parent signed, unless a court order for custody, visitation, or child support has been made in a case where the person seeking the cancellation is a party. Only one parent's signature is required to rescind a VDOP.
