All states have the legal authority to require tobacco retailers to obtain a license before selling tobacco products. Licensing fees can cover the costs of administering the licensing program and enforcing tobacco retail policies.

(a) Any person 21 years of age or older who sells, gives, or otherwise furnishes tobacco, tobacco-related devices, or electronic delivery devices to a person under the age of 21 years is guilty of a petty misdemeanor for the first violation.
