What Are the Three Forms of Discovery? Depositions. Written discovery. Document production.

One of the most commonly used exceptions to Texas' statute of limitations is the discovery rule. This gives a victim two years from the date he or she discovered the injury (or reasonably should have discovered it) to file rather than the date of the accident. This exception applies to hidden or delayed injuries.

Under Level 2 discovery, each side is only allowed 25 written interrogatories that ask for more than identifying information about a document. Additionally, the responding party may respond by telling the other side where the information can be found in public records instead of answering the question directly.

A document not filed electronically may be served in person, by mail, by commercial delivery service, by fax, or by email.

The Texas courts adopted Rule 21a which allows a party to serve official court documents via email. Before the adoption of Rule 21a, parties had to mail hard copy versions of court filings. This slowed down the litigation process and created a higher risk of parties not receiving filed documents and materials.

Send the disclosures by email, e-file, or certified mail. A document not filed electronically may be served in person, by mail, by commercial delivery service, by fax, or by email. It is usually easiest to send digital documents to the other parties' email addresses.

192.2 Timing and Sequence of Discovery. (a) Timing. Unless otherwise agreed to by the parties or ordered by the court, a party cannot serve discovery on another party until after the other party's initial disclosures are due.

Every case filed in Texas state court requires the plaintiff to choose a discovery plan: Level One, which applies only for cases where the plaintiff seeks less than $100,000 in damages; Level Two, which applies by default to all other cases and has its own specific set of deadlines; and Level Three, which allows the ...

Still, personal emails are certainly discoverable under the Federal Rules of Civil Procedure. Specifically, personal emails would be considered “electronically stored information” under FRCP 34(a)(1)(A) and discoverable so long as they meet the relevance and proportionality requirements of FRCP 26(b).

Rule 190 - Discovery Limitations 190.1 Discovery Control Plan Required. Every case must be governed by a discovery control plan as provided in this Rule. A plaintiff must allege in the first numbered paragraph of the original petition whether discovery is intended to be conducted under Level 1, 2, or 3 of this Rule.
