To have your arrest record sealed, you must file a petition in the city or county where you were arrested. The petition must then be served to both the law enforcement agency that made the arrest and the prosecuting attorney. You will need to work with a criminal defense attorney throughout the petition process.

After employers in California make a conditional employment offer, they may order a criminal background check that goes back only seven years (with some exceptions). Therefore, employers cannot see convictions older than seven years and cannot pass over job applicants based on seven-plus old convictions.

The key difference between expunging a person's criminal record and sealing it is that a sealed record still “exists” in both a legal and physical sense, while expungement results in the deletion of any record that an arrest or criminal charge ever occurred.

You may request that a court seal your arrest records or criminal records. If a judge agrees with your request, the records will no longer be available to the public. However, some government agencies will still be able to see your sealed record. If the order is granted, the judge will use the CR-410 order form.

Records of arrests that don't bring convictions also would be sealed. The law goes into effect July 1, 2023. The bill would apply to offenses like domestic violence. It excludes those convicted of serious and violent felonies, and felonies requiring sex offender registration.

Serious sex offenses, child ography, and certain vehicle offenses are not eligible for expungement. The full list of offenses not eligible for expungement if probation was sentenced includes: Misdemeanors under Vehicle Code Section 42002.1. Penal Code Section 286(c)

Governor Newsom signed SB731 into law, and this "clean slate" law opens doors for those who have served their sentence for previous crimes and stayed out of trouble with the law for four years.

If you were never on probation or have successfully completed your probation, you are qualified for expungement. If you are still on probation, you must have your probation terminated before you can apply for expungement. In order to have your probation terminated, you must petition the court.
