There are three elements that must be present for a contract to exist: offer, acceptance, and consideration.

Assignment of a real estate contract is looked upon with suspicion by lots of folks. While it is not legal in all states, under Texas law, contracts are assignable unless there is a specific clause in the contract that prohibits it.

Promulgated Contracts 1-4 Family Residential Contract (Resale) Residential Condominium Contract. Farm and Ranch Contract. Unimproved Property Contract. New Home Contracts.

The Texas Real Estate Commission (TREC) has a promulgated form available to the public for terminating the contract. The Texas Association of Realtors (TAR) has its own version of the form, which has the identical information. Submitting the completed termination notice to the listing agent constitutes notice.

TREC contract forms require the buyer to deliver any earnest money to the escrow agent. If the buyer fails to deliver the earnest money within the time required, the seller may terminate the contract, exercise the remedies under Paragraph 15 of the contract, or both.

Real estate license holders are required to use these forms. However, TREC contract forms are intended for use primarily by licensed real estate brokers or sales agents who are trained in their correct use. Mistakes in the use of a form may result in financial loss or a contract which is unenforceable.
