IRS Form 1040NR is a variation of Form 1040, which taxpayers use to file their Annual Tax Return. This variation is for individuals who are not American citizens and who do not pass the Substantial Presence Test. IRS Form 1040NR is also known as the U.S. Nonresident Alien Income Tax Return.

In 2022, the Rhode Island standard deduction increased to $9,300, a $250 increase from $9,050, for a single person, and $18,600 for people married and filing jointly, up $500 from 2021.

If you are a Rhode Island resident and you are required to file a federal return, you must also file a Rhode Island return. Even if you are not required to file a federal return, you may still have to file a Rhode Island return if your income exceeds the amount of your personal exemption.

Depending on your annual income, filing status, number of exemptions and other indicators, both Residents and Nonresidents may have a filing requirement. Every resident individual of Rhode Island who is required to file a federal income tax return must file a Rhode Island individual income tax return (RI-1040).

You may need to file Form 1040-NR if you: Were a nonresident alien engaged in a trade or business in the United States. Represented a deceased person who would have had to file Form 1040-NR. Represented an estate or trust that had to file Form 1040-NR.

You must file Form 1040-NR, U.S. Nonresident Alien Income Tax Return only if you have income that is subject to tax, such as wages, tips, scholarship and fellowship grants, dividends, etc. Refer to Foreign Students and Scholars for more information.
