When a legal resident of the District of Columbia dies without a Will, that person's property must be probated through the same Probate Court process as the property of a person who died with a Will.

Any person with a valid unbarred claim or with a valid unbarred judgment who has not been paid within the 8 month period may petition the Court for an order directing the personal representative to pay the claim to the extent that funds of the estate are available for such payment.

If you need to obtain a Letter of Administration you will need to file an application with your county court.

Compensation. Except as may otherwise be ordered by the Court for good cause shown in respect to a supervised personal representative or a special administrator, a personal representative is entitled to reasonable compensation for services.

Order of payment. (9) All other just claims. (b) No preference shall be given in the payment of any claim over any other claim of the same class, and a claim due and payable shall not be entitled to preference over claims not due.

An unsupervised personal representative is not required to file an inventory or accounts with the Court and is not subject to continuing court supervision. If the estate is supervised, the personal representative will be required to file an inventory and accounts, which are audited by the Court.

(a) An abbreviated probate proceeding is a proceeding for the probate of a will or a determination of a decedent's intestacy and for the appointment of a personal representative.
