A New Mexico eviction process does not allow a landlord to evict a tenant without good cause. As long as the tenant does not violate any rules, they can stay until their rental period ends. However, if a tenant overstays their lease term without applying for a renewal, they can be evicted.

Seven-Day Unconditional Quit Notice: When a tenant materially violates the lease or rental agreement a second time within a six-month period, the landlord does not have to give the tenant an opportunity to fix the problem. Instead, the landlord can give the tenant a seven-day unconditional quit notice.

The New Mexico 7-day notice to quit allows a landlord to evict a tenant who has violated the terms of their lease, giving them seven (7) days' notice to comply with the notice or move out.

If the residency is month-to-month, the thirty (30) day notice must be given at least thirty (30) days before the periodic rental date; for example, if the rent is due on the 1st, the notice must be given at least thirty (30) days before the 1st. 2.

A landlord is required to give you a three-, seven- or thirty-day notice with the reasons for terminating the lease before the landlord can go to court to evict you. But, you can agree to move out voluntarily. You may still owe the rent money to the landlord even if you move out.

In New Mexico abandonment means the absence of the tenant from the premises, without notice to the landlord, for more than seven continuous days, and only after rent is delinquent. When abandonment is confirmed the rental agreement may be terminated, and the process of handling any personal property left behind begins.
