Does NY require a CDS license?

New York State Public Health Law Article 33 requires a license, unless otherwise expressly provided, to be issued by the department of health to engage in controlled substance activity. Licenses are valid for two years from their effective date.

Controlled substances are defined under federal law. They include opioids, methamphetamines, marijuana, alcohol products, hallucinogenic drugs and other narcotics. Federal registration is also required.

The California Bureau of Narcotic Enforcement (BNE) was a drug law enforcement agency, under the California Department of Justice (CA DOJ). The BNE was established in 1927, and was the oldest narcotic enforcement bureau in the United States at the time of it disbanding.

A federal DEA certificate is required for all qualified practitioners who write prescriptions for controlled substances. However, many individual states also require a practitioner to hold a Controlled Dangerous Substances (CDS) certificate in addition to a DEA certificate.

Anslinger retired in 1962 and was succeeded by Henry Giordano, who was the commissioner of the FBN until it was merged in 1968 with the Bureau of Drug Abuse Control, an agency of the Food and Drug Administration, to form the Bureau of Narcotics and Dangerous Drugs, an agency of the United States Department of Justice.

A licensed Nurse Practitioner (NP) who is registered with DEA is authorized to prescribe schedule II, III, IV, and V controlled substances. A controlled substance prescription issued by a NP must contain the imprinted name of the NP but is not required to contain the imprinted name of the collaborating physician.
