Code of Civil Procedure (“CCP”) section 1005 states the amount of time required to give notice of most motions. The moving papers must be personally given to each opposing side at least 21 days before the hearing on the motion, OR mailed to each opposing side at least 26 days before the hearing on the motion.

Notice of a summary judgment motion, as well as the papers in support of the motion, must be filed with the court and served on all parties at least 75 calendar days before the scheduled hearing date of the motion. All papers opposing a motion must be served and filed not less than 14 days before the hearing date.

A person is served by mail five days after the papers are mailed and both the person sending the papers and to person to receive the papers are in California. A person is served by mail ten days after the papers are mailed if either the person mailing or the person receiving the papers is outside California.

Unless otherwise ordered or specifically provided by law, all pretrial motions, accompanied by a memorandum, must be served and filed at least 10 court days, all papers opposing the motion at least 5 court days, and all reply papers at least 2 court days before the time appointed for hearing.

(3) Any opposition must be served and filed within 15 days after the motion is filed.

Personal Service: The claim is given to the person(s) you are suing. This must be done at least 15 days before the court date. If the person lives outside of Los Angeles County, they must be served at least 20 days before the court date.

“Time served” is a term colloquially used by courts when imposing a sentence that is deemed to be completely satisfied by the defendant's previous time spent in custody while awaiting sentencing.

If you have an address for the restrained person, you can ask the sheriff or marshal to serve your papers, and they will do it for free. You believe the restrained person is avoiding (evading) personal service. Be ready to explain why you think the restrained person is avoiding service.
