Records to be kept for six years: The strata corporation must keep the following records for at least six years: minutes of annual and special general meetings and strata council meetings, including the results of any votes. books of account showing money received and spent and the reason for the receipt or expenditure.

Strata corporations and sections are allowed to have age-restriction bylaws that require one or more persons residing in the strata lot to have reached an age that is not less than 55 years. For example, an age-restriction bylaw could be for ages 55 and greater, or age 60 and greater, etc.

To officially amend (create, change or delete) bylaws, the strata corporation or section must file the change on a “Form I: Amendment to Bylaws” at the Land Title Office. New and changed bylaws do not take effect until they are filed at the Land Title Office with the exception of pet bylaws.

Prior to November 24, 2022 a developer was required to issue a Rental Disclosure Statement (Form J) declaring: the number of lots an owner developer intends to rent out until a specific date; or. that there are no bylaws which restrict rentals; or. that there is a bylaw which restricts rentals.

Under the Act, Owner Developers must provide prospective purchasers with a “Rental Disclosure Statement” (Form J) which has been filed with the Superintendent of Real Estate, if the Owner Developer intends to rent or preserve the right to rent any of the residential units.

If significant strata bylaws are repeatedly or continuously broken by a tenant, the strata corporation can take steps to evict the tenant. The Residential Tenancy Branch Policy Guideline #27 (updated November 21, 2022) has more information on this.

All tenants have the following rights under the Strata Property Act: to obtain a copy of the current bylaws and rules and a “Form K: Notice of Tenant's Responsibilities” from the landlord. to inspect at no charge and obtain copies of the bylaws and rules from the strata corporation.

Rules. 125 (1) The strata corporation may make rules governing the use, safety and condition of the common property and common assets. (2) A rule is not enforceable to the same extent that a bylaw is not enforceable under section 121 (1).
