If the allegation is substantiated, the county will refer information regarding the caregiver along with case information to the Child Abuse Central Index (CACI) of the California Department of Justice for inclusion in the statewide database.

Reasonable suspicion of emotional abuse that must be reported often results from verbal disclosures or direct observation and involves any person willfully causing or permitting any child to suffer unjustifiable physical pain or mental suffering, or endangering the child's person or health (Penal Code 11165.3).

If the allegations are either unfounded or inconclusive, no report can be submitted to or accepted by the CDOJ and a person will not be listed on the CACI. Minor offenders placed on the list prior to the age of 18 will remain on the CACI for 10 years.
