Certain Tennessee non-profits are eligible to be exempt from Tennessee state and local sales tax. You will need to complete an application for non-profit sales and use tax exemption and submit it and all required documentation (copies of articles, bylaws, IRS determination)to the Tennessee Department of Revenue.

To be eligible for a sales and use tax exemption, you must be a TCA Section 67-6-322, a 501(c)(3), a 501(c)(5) Labor Organization or another organization defined as non-profit by Tennessee's legal code. Completion of a one page application will register your organization for an exemption.

The IRS will mail you a hard copy of your tax ID. You should receive the hard copy within seven to 10 business days. Telephone the IRS at 800-829-4933 to obtain a tax ID number for your farm.

Tennessee Nonprofit Sales Tax Exemption In some states, your organization is not automatically exempt from state sales tax, even after obtaining 501(c)(3) recognition from the IRS. You must file a separate application in order to receive state sales tax exemption.

Tennessee does not recognize the use of exemption certificates issued by other states, except for resale certificates for purposes of making tax-exempt purchases in Tennessee for resale outside of Tennessee to end users located outside of Tennessee.
