Can I claim homestead exemption on rental property in Texas? Nope. Homestead exemption is available only to homeowners who reside in that house. If you own multiple properties, you can claim homestead exemption only on your principal residence.

For persons age 65 or older or disabled, Tax Code Section 11.13(c) requires school districts to provide an additional $10,000 residence homestead exemption. Tax Code Section 11.13(d) allows any taxing unit to adopt a local option residence homestead exemption. This local option exemption cannot be less than $3,000.

An exemption certificate must show: (1) the name and address of the purchaser; (2) a description of the item to be purchased; (3) the reason the purchase is exempt from tax; (4) the signature of the purchaser and the date; and. (5) the name and address of the seller.

This local option exemption cannot be less than $3,000. To qualify for the age 65 or older residence homestead exemption, the individual must be age 65 or older, have an ownership interest in the property and live in the home as his or her principal residence.

The Texas Sales and Use Tax Exemption Certification form is available from the Texas Comptroller of Public Accounts. This form should only be used for official University business. The Exemption Certification form is completed and signed at the department level.
