Is income averaging still available? ... The general 4-year income averaging rule expired in 1986. Currently, income averaging can only be used by farmers and fishermen for their business income and, in some cases, for lump-sum retirement plan distributions.

A provision in the tax code allows use of a special formula called ten year income averaging by qualifying individuals or their beneficiaries to determine the tax liability with respect to a lump sum distribution they may receive from an employer-sponsored qualified plan or annuity.

A provision in the tax code allows use of a special formula called ten year income averaging by qualifying individuals or their beneficiaries to determine the tax liability with respect to a lump sum distribution they may receive from an employer-sponsored qualified plan or annuity.

There is no limit on indirect rollovers (or direct) to a retirement plan, such as a 403(b) or 401(k) plan. The IRA involved may be an Individual Retirement Account or an Individual Retirement Annuity. The IRS will not apply the one-rollover-per-year rule to IRAs until January 1, 2015.

A withdrawal removes the money from your retirement plan and may involve some penalties. A rollover is a transfer of funds from one type of retirement program to another and can be accomplished without any tax penalty if the funds involved have the same tax considerations.

A direct rollover sends the funds from your current plan administrator directly to another administrator. An indirect rollover, on the other hand, involves the funds from the plan administrator being given to the plan participant, with the intent to place those funds into an IRA.

For example, funds can be distributed from your plan and moved right into a new 401(k) plan or to an IRA that you have. This is called a "rollover," and a rollover is a distribution. But it doesn't trigger any penalties because the money is not coming to you. It's moving to another investment.

DEFINITION of Eligible Rollover Distribution An eligible rollover distribution is a distribution from one qualified plan that is able to be rolled over to another eligible plan. Types of qualified plans include IRAs and 403(b) plans.

Tax benefits You'll owe federal income taxes on every monthly pension payment. But with a lump sum, you don't have to pay the tax man if you don't need the money. If you roll the lump sum into an IRA, you'll only be taxed on the money that you choose to take out each month.

Tax Form 4972 is used to reduce the tax load for lump sum distribution of a qualified retirement account. To qualify, the entire account must be payed out to the beneficiary in one tax year, the plan must be an employer plan and the beneficiary must be have been born before January 2, 1936.
