Answer: A "contested case" is a proceeding in which the legal rights, duties or privileges of a party have to be determined by an agency after an opportunity for an evidentiary hearing.

The Office of Administrative Hearings (OAH) was created by HB 1692 (83rd Texas Legislature, Reg. Session) and began operations on January 1, 2014. OAH conducts hearings statewide adjudicating Lemon Law and Warranty Performance complaints filed by Texas consumers.

Minnesota law often grants affected individuals and businesses a right to challenge the actions of their government. These matters, called “contested case proceedings,” result when a government agency takes an action, and an individual or entity appeals that action through the process provided by the agency.

Contested cases require that both sides argue their position to explain why the law says that a judge should rule in for them. Contested cases will generally require much more work than an uncontested case—even if the other side is not represented by an attorney.

What happens at a contested case hearing? At the hearing, the ALJ listens as the parties offer evidence about the issues. Witnesses answer questions under oath, and each party explains its side of the case. After the hearing, the ALJ reviews the evidence and makes a decision on each issue.
