Georgia is an at-will employment state, which means you can be fired for any reason that is not illegal at any time. This includes while you are receiving workers' compensation benefits for an injury suffered on the job. The same rule allows you to quit a job without repercussions at any time and without reason.

You are entitled to weekly income benefits if you are unable to work for more than 7 days. Your first check should be mailed to you within 21 days after the first day you missed work. If you miss more than 21 consecutive days, you will be paid for the first week.

Depending on the details of your work injury, you may be able to receive wage benefits for up to 400 weeks. Sometimes, a worker is able to return to work but at a reduced capacity. You may still be able to receive workers' compensation benefits if your injury prevents you from working at the same level as before.

This range can be three to seven years. That said, there is not usually a limit on permanent disability benefits. However, some states do stop weekly benefits when employees reach the age of 65. Also keep in mind that not all states will provide permanent partial disability benefits.

In most cases, the statute of limitations for workers' compensation in Georgia is one year from the date of the work accident.

Once your average weekly wage is determined, you will receive two-thirds of this amount (but no more than $675 per week for total disability and $450 per week for temporary partial disability) as part of your workers' compensation. (This amount can change depending upon your date of accident).

The average settlement for a Georgia workers' compensation claim depends on certain factors. You are entitled to benefits through workers' compensation without pursuing a settlement. That being said, some employees are better off seeking more from the insurance company to account for their future needs.

The law requires any business with three or more workers, including regular part-time workers, to have workers' compensation insurance. Coverage can be verified by going to .sbwc.georgia.gov and in the Popular Topics box click on “verify workers' compensation insurance coverage”.
