The Queensland Civil and Administrative Tribunal (QCAT) is an independent, accessible tribunal that efficiently resolves disputes on a range of matters. The tribunal's purpose is to provide a quick, inexpensive avenue to resolve disputes between parties and make decisions.

QCAT decisions and agreements are legally binding and enforceable.

If a party makes an offer to settle which is not accepted by a second party and, in the opinion of QCAT, the decision of QCAT is not more favourable to the second party than the offer, then QCAT may award the first party their reasonable costs incurred in conducting the proceeding after the order was made.

What is an affidavit? An affidavit is a written form of evidence used in court proceedings. An affidavit sets out the facts as you remember them. In some legal matters, the evidence you want the court to hear about your matter must be in an affidavit (e.g. family law matters).

Fees and costs The applicant may have to pay a fee (Opens in new window) to apply to QCAT. If you have difficulty in paying the application or appeal fee, you may apply to QCAT for the fee to be waived. An application to waive the fee will only be approved in special circumstances.

Reopenings. The fee to apply for a QCAT proceeding to be reopened is the same amount as the current fee payable for the original application or referral that started the proceeding. In cases where there is no fee payable for the original application or referral, the fee to reopen the proceeding is generally $352.00.

QCAT may appoint you for all financial matters or may specifically detail the matters for which you are appointed. If appointed for all financial matters, you are responsible for all financial matters that the adult did, or legally could have conducted, on their own if they had capacity.
