Releasing your California mechanics lien follows the same process as filing it. You either visit the clerk's office or mail your document to them. Note that your mechanics lien release document must be filed in the same clerk's office where the original mechanics lien was recorded.

Mechanics liens expire unless you file a lawsuit to enforce your Lien within 90 days of when the lien was recorded. Just recording a lien does not get you paid, if you do not sue to collect on it in 90 days. This is known as “perfecting” your lien.

Under California Civil Code 8400 – 8494, a property owner can petition the court for a release order, releasing a California mechanics lien from the property. In order to make a petition, the property owner must give the lien claimant 10 days notice, giving them time to release the lien voluntarily.

In California, a release and waiver of liens on full payment (unconditional) is a legal document exchanged between the property owner and the contractor upon the completion of a project.

A lien expires 10 years from the date of recording or filing, unless we extend it. If we extend the lien, we will send a new Notice of State Tax Lien and record or file it with the county recorder or California Secretary of State. We will not release expired liens.
