Federal Wage Garnishment Limits for Judgment Creditors If a judgment creditor is garnishing your wages, federal law provides that it can take no more than: 25% of your disposable income, or. the amount that your income exceeds 30 times the federal minimum wage, whichever is less.

South Carolina is one of a handful of states limiting the types of debts that can be collected by taking funds directly out of a paycheck, called "wage garnishment." In South Carolina, your wages can't be garnished to collect consumer debts.

You can also potentially stop most garnishments by filing for bankruptcy. Depending on the type of debt that's being garnished, you might have other options. For example, if the IRS is garnishing your wages because of overdue taxes, you can make a settlement offer (an "offer in compromise") or set up a payment plan.

In some instances, filing for bankruptcy may be the solution to assist you with your wage garnishment. You may also be able to protect yourself by filing an exemption claim with the court or by raising an objection to the wage garnishment.

Under current law, the amount of an individual's disposable earnings subject to garnishment is either 25% of the individual's disposable weekly earnings or the amount by which an individual's disposable earnings for a week exceed 30 times the state or federal minimum wage, whichever is less.

Only a portion of your pay can be garnished. The amount that can be withheld from your pay depends on something called “disposable earnings”. Your disposable earnings are what is left after deductions from your gross pay for taxes and certain health insurance costs.

The act changes the amount subject to garnishment to 20% of the individual's disposable weekly earnings 40 times the amount by which an individual's disposable earnings for a week exceed the state or federal minimum wage.
