Pre-1907 Water Rights: The New Mexico Constitution recognizes and confirms all existing appropriations of water for useful or beneficial purposes. These pre-existing vested water rights date from the initial use of that water.

The Water Right Summary Report allows querying by the water right file number or the owner name. The WR File Nbr query shows the purpose, status, total acres, total diversion, owner, and a list of all documents on file with the office such as applications, permits, and court orders.

Recent prices for water rights have ranged as high as $35,000 to $45,000 per right to consume an acre-foot each year in the Santa Fe area to $9,000 to $35,000 in the Middle Rio Grande to $2,400 in the Roswell Artesian Basin.

Article 16 of the New Mexico Constitution provides that the water of every natural stream, perennial or torrential, not appropriated prior to statehood belongs to the public and is subject to appropriation for beneficial use.

The basic authority for water quality management in New Mexico is provided through the State Water Quality Act which establishes the Water Quality Control Commission (WQCC). The WQCC is the state water pollution control agency for purposes of the Federal Clean Water and portions of the Safe Drinking Water Acts.

The Active Water Resource Management (AWRM) initiative was launched in January 2004 in response to continued drought conditions in our state. Active Water Resource Management (AWRM) refers to the essential tools and elements needed to enable the State Engineer to actively manage the state's limited water resources.

rights in New Mexico are regulated by the Office of the State Engineer (OSE).
