Small Claims Court is a special part of the court where you can sue for money without a lawyer. You cannot sue to make someone do something or for pain and suffering. Anyone 18 years of age or older can sue in Small Claims Court. If you are less than 18 years old, your parent or guardian may sue on your behalf.

You can sue for up to $10,000, if you are an individual or a sole proprietor. Corporations and other entities are limited to $5,000. In addition, a party (individuals or corporations) can file no more than two claims exceeding $2,500 in any court throughout the State of California during a calendar year.

Small Claims Court handles cases in which the demand is for $5,000 or less. If the amount of money you are seeking to recover is more than $5,000, but less than $20,000, your case should be filed in the Special Civil Part-Civil.

No Limitations to Pain and Suffering Damages For those who wish to seek compensation for any physical or mental pain or suffering, New Jersey – unlike many other states – does not impose a cap on the maximum amount of money that can be awarded.
