DNA testing in NYC requires a parent's consent while testing children. Hence, if a child is born out of wedlock, he does not have a legal father. As a result, testing the child's DNA is only possible when the mother consents to it.

If a man was not married to the mother of the child, he has no obligation to pay support for the child, and has no legal right to custody or visitation with the child, unless he is legally named the father of the child, through an order of filiation or an acknowledgment of paternity.

A paternity test requires at least two samples: one from the child and one from the possible father. Ideally, a sample from the mother should also be tested. The results make it possible to rule out paternity or classify it as highly probable.

When a child is born to parents who are not married to each other, the biological father is not considered the child's legal parent unless the father has signed an "Acknowledgment of Paternity" (usually done at the hospital at the time of the child's birth) declaring himself to be the child's father, or an "order of ...

Statute of Limitations The time to commence a paternity proceeding under Article 5 of the Family Court Act is any time during the pregnancy of the mother, or after the child is born, but not after twenty one years, unless paternity is somehow acknowledged by the father, or he paid support.

If you have signed an Acknowledgement of Paternity and believe it was a mistake, you must file a petition within 60 days of the date it was signed to ask the Court to vacate the Acknowledgement.

The way that you will establish paternity will depend on your circumstances. The easiest way to obtain paternity is to have your name put on the child's birth certificate once the child is born. You can also get a court order or have an administrative agency do this for you.
