The “Special Use Permit” is a zoning term and process used by a municipality to encourage, but still regulate, land use in a zoning district by making it subject to a special review and criteria detailed in the zoning ordinance. See, Town Law Section 274-b, Village Law Section 7-725-b and City Law Section 27-b.

A Conditional Use Permit is required for any use listed under the conditional use section in a given zoning designation. Conditional use permits are generally required for a variety of uses, including but not limited to, schools, churches, signs, mobile home parks, some commercial businesses etc.

SUPs are to be issued for one specific use and are required for each tract of land. Legally issued SUPs shall expire one year after the date of approval if construction, or the use permitted, has not started. A one-time only six (6) month extension may be granted by the Zoning Board of Adjustment (ZBOA) upon request.

“Special Use Permit Application” means a request filed with the Zoning Administrator to consider a specific location not permitted by right in any district(s). “Variance Application” means a request requesting relief from the requirements of the code for reasons to be demonstrated by the applicant.

A Special Use Permit runs with the land for two years and authorizes submittal of an application for approval of final plans by Zoning Administration staff, and issuance of necessary land use and building permits for the approved development.
