At the bond hearing, the judge will decide whether you must be detained or released while your case makes it's way towards trial. If granted release, the Judge must implement the “least restrictive” conditions possible to assure the safety of the community and your appearance back at court.

If the amount of your bond is more than your fine(s) and court costs, you will be entitled to a refund of the balance of your bond money remaining after the fine(s) and costs are paid. Bond refunds will be payable only to the defendant unless otherwise ordered by the court.

A defendant posts bail by paying the required amount to the court. The court holds this money until the court hearing. If the defendant fails to attend a court date, they forfeit the money and may be sent back to jail. If a defendant complies with bail, the court returns their money at the end of their matter.

In Missouri, the defendant is in most instances entitled to be released upon payment of a 10% cash fee paid to the Court Clerk as the bond. This money, unlike money paid to a bondsman, is then refunded to the defendant at the conclusion of the case.

They must appear in court as required (i.e., hearings, trial, etc.) They must submit to the “orders, judgment, sentence, and court process. They must not break any other laws, tamper with the victims, or contact witnesses while out on release.
