3 Answers. A EFB is a legal replacement for paper charts and you are not required to carry backup if you are operating as part 91 single engine piston. Advisory Circular 120-76B is in reference to part 91F (Large and Turbine-Powered Multiengine Airplanes).

The FAA defines the EFB software as Type A, B or C. Type A software applications are those applications intended for use on the ground or during noncritical phases of flight. Type A applications do not include aeronautical information required for flight operations.

Classes of EFB System Hardware Class 1 EFB Systems did not require NAA airworthiness approval. They had to be stowed for takeoff and landing and are limited to providing supplemental information only. Class 2 EFB Systems required a limited NAA airworthiness approval.

EFB Approval Process for FAA Certificated Operators Before using an EFB when operating under Part 91K, 125, or 135, authorization must be received from the principal inspector. The procedures for obtaining this approval are contained in FAA Order 8900.1 and AC 120-76D.

In general, for most Part 91 operations with a maximum gross takeoff weight (MTOW) of less than 12,500 pounds, iPad's are legal to use as an EFB.
