To terminate a housing lease and move out, the tenant must give the landlord written notice or come to an agreement with the landlord for ending the lease. The tenant must use the Tenant's Notice to Terminate the Tenancy (Form N9) which is available in any LTB office.

The tenancy will continue on a month-to-month or another fixed-term basis. Your landlord cannot force you to sign another fixed term. If you want to vacate after your lease is up, one month's notice must be provided to the landlord. The tenancy agreement does not say what will happen at the end of a fixed term.

In Ontario, when a residential lease expires, and there is no new lease, the tenancy automatically becomes a month-to-month tenancy. The main advantage for tenants with a month-to-month tenancy is that they have much more flexibility if they decide to move.

The end of a fixed term tenancy or lease does not mean that the tenant has to move out or sign a renewal or new lease in order to stay. The lease is renewed automatically on a month-to-month basis (if the rent is paid monthly) or week-to-week basis (if rent is paid weekly).

The use of the “official housing lease” document is mandatory and your landlord must give you a copy within 10 days after signing it. However, be aware that an unofficial written lease or a verbal lease (when you have agreed verbally with the landlord to live in the housing) is also valid.

The lease forms are on sale at offices of the Tribunal administratif du logement, in bookstores and through Publications du Québec (1 800 463-2100).

Filling out the formulaire de bail de la Régie du logement is straightforward: Part A: the contact information of both the tenant and landlord. Part B: a description of the rental (address, parking spots, amenities, etc.) Part C: the duration of the lease agreement.
