A roommate who isn't on the landlord-tenant lease agreement has a rental agreement with the legal tenant which isn't covered by the Residential Tenancies Act (RTA). This means that the responsibility will generally fall on you to evict your roommate – they are your subtenant.

In Ontario, landlords cannot say “no” to overnight guests. Just like homeowners, tenants have the right to say who they want to invite into their homes. A landlord who tries to control who stays overnight on the rental premises may be harassing a tenant.

Neither a landlord or tenant can unilaterally break a lease, however both of you can agree to end the lease. If both parties agree, the lease can be terminated with an N11 agreement.

The deal between a lease holder and a roommate is a simple contract, whether written down or verbal and there is no law requiring a notice period to end it. Disputes also cannot be taken to the Landlord and Tenant Board – they have to go through small claims court.

Generally, tenants who rent a single or shared room have the same rights as most other residential tenants in Ontario.

If your agreement is not with the landlord, you will not have protection under the Residential Tenancy Act. This is common when an existing tenant allows a roommate to move in without getting the landlord's agreement to add that person to the tenancy agreement.

Rental Unit / Lease Agreement This is a binding agreement between the roommates living together in the rental unit. Each roommate will carry out their responsibilities contained in this agreement in a timely manner.

Typically, a landlord cannot raise rent or charge extra fees when a tenant adds a roommate or occupant. Ontario's Residential Tenancies Act (RTA) prohibits landlords from collecting any refundable or non-refundable fees, except for a previously agreed upon deposit for keys and/or one month's rent.
